1. Acceptance of Terms
By accessing or using our services, including courses, labs, and subscriptions, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
2. User Obligations
To access certain features, you may be required to create an account. When creating an account, you must provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. License to Use
All purchases grant you a limited license, not ownership. You are granted a non-exclusive, non-transferable, revocable, individual-use license.
You may NOT share your account or login credentials, allow multiple users to access under one account, copy, reproduce, distribute, or resell any content, upload content or course materials to external platforms, or use content for commercial training without permission. We reserve the right to revoke access at any time.
4. Accounts
You are responsible for maintaining account security and all activity under your account. We reserve the right to monitor usage patterns to detect violations.
We reserve the right to refuse service, suspend access, or cancel transactions at any time for any reason, including suspected fraud, abuse, or violation of these Terms. We may also investigate accounts, transactions, and usage patterns for suspected fraud, abuse, or violations of these Terms and take appropriate action, including suspension or termination.
5. Course, Lab, and Access Terms
Course Access
Access is granted for the period specified at purchase and expires automatically at the end of that period. Re-purchasing a course creates a new access period. Lifetime access is not guaranteed unless explicitly stated.
Lab Access (VMs)
Labs are provided in controlled environments for educational use only. VMs are temporary environments that may be reset, suspended, or deleted at any time, and we do not guarantee persistence beyond 90 days of inactivity. You are responsible for saving your work externally, and we are not responsible for any loss of data, work, or progress within lab environments.
6. Subscription & Billing
By purchasing a subscription, you expressly agree that your payment method will be automatically charged on a recurring basis until you cancel. Subscriptions automatically renew at the end of each billing cycle, and you authorize recurring charges to your payment method. Pricing may change with notice.
You may cancel at any time, and cancellation takes effect at the end of the current billing period. No prorated refunds will be provided. If a payment fails, access may be suspended immediately, and continued failure may result in termination.
7. Refund Policy
We offer a 100% Risk-Free Guarantee for eligible purchases.
If you are not satisfied with your purchase, you may request a full refund within 72 hours of enrollment by contacting us.
Refunds are limited to one request per user per product. We reserve the right to deny refund requests in cases of abuse, excessive usage, or violations of these Terms.
Exclusions
- Subscription renewals are not eligible for refunds once billed
- Refunds will not be issued for accounts that have violated these Terms
- Refunds are not available after the 72-hour period, regardless of usage
Chargebacks You agree not to initiate chargebacks without first contacting us to resolve the issue. Unauthorized chargebacks may result in account termination.
Abuse of Promotions You may not misuse promotions, discounts, or pricing errors. We reserve the right to cancel orders or deny refunds resulting from such misuse.
8. Acceptable Use & Academic Integrity
You agree not to use labs outside intended environments, conduct unauthorized or real-world attacks, attempt exploitation outside controlled labs, share accounts, circumvent platform protections, or use automation, scraping, or bots.
You also agree not to share answers, solutions, or walkthroughs, misrepresent your work, or bypass learning objectives.
We reserve the right to investigate suspected violations. Violations may result in immediate termination, permanent ban, or legal action. We may also revoke certifications and suspend or terminate accounts.
9. System Requirements & Third-Party Services
You are responsible for ensuring your system meets minimum requirements, including a stable internet connection, a modern web browser, and a computer capable of running virtualized lab environments. Additional requirements may apply for specific courses or labs.
We are not responsible for device incompatibility or performance issues related to your system or internet.
We rely on third-party platforms, including hosting providers, payment processors, and lab environments. We are not responsible for downtime, errors, or data loss caused by third-party services.
10. Intellectual Property
All content is owned by Blue Cape Security, including courses, labs, videos, materials, and frameworks. This content is protected by copyright and trademark laws, and unauthorized use is prohibited.
11. Disclaimers, Certification, and No Reliance
All content is provided for educational purposes only and on an “AS IS” basis without guarantees. We do not guarantee job placement, certifications, career outcomes, or skill mastery. Nothing provided constitutes legal advice, security advice, or compliance guidance.
We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free. We do not guarantee the accuracy, completeness, or timeliness of any training materials, and cybersecurity practices may evolve, making content outdated.
Completion of any course or lab does not guarantee certification, qualification, employment, or professional competency.
You agree not to rely on the Service for security decisions, business decisions, or legal or compliance actions and are solely responsible for how you apply any knowledge.
12. Service Availability & Geographic Restrictions
We may modify or remove content, interrupt or discontinue services, or change platform functionality at any time. We do not guarantee uptime or availability.
You may not access or use the Service if you are located in a country subject to United States sanctions or export restrictions, or if you are prohibited from receiving such services under applicable law. You agree not to access or use the Service in violation of any applicable export control or sanctions laws, including through circumvention methods such as VPNs or proxy services.
13. Termination & Liability
We may suspend or terminate access for violations of these Terms, misuse or abuse, or fraud. No refunds will be issued.
To the maximum extent permitted by law, liability is limited to the amount you paid. We are not liable for indirect damages, loss of income, or loss of data.
14. Indemnification & Force Majeure
You agree to indemnify and hold harmless Blue Cape Security from any claims arising from your use or misuse of the Service.
We are not liable for delays or failures caused by events beyond our control, including internet outages, cyberattacks, or third-party failures.
15. Dispute Resolution & Governing Law
Any dispute shall be resolved through binding arbitration in Deschutes County, Oregon. You agree to resolve disputes individually and waive any right to participate in a class action.
These Terms are governed by the laws of Missouri, United States.
16. General Terms
These Terms constitute the entire agreement between you and the Company and supersede all prior agreements or understandings.
You may not assign or transfer your rights under these Terms without our prior written consent.
Provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution shall survive termination.
17. Changes to Terms & Contact
We may update these Terms at any time. Continued use of the Service constitutes acceptance of updated Terms.
